Welcome to MeadowTrailBreeze ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at meadowtrailbreeze.site (the "Service") operated by MeadowTrailBreeze.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
MeadowTrailBreeze offers exclusive yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate getaways
- Exclusive gatherings
- Extensive charters
All services are subject to availability and weather conditions. We reserve the right to modify or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be at least 18 years old
- Supply accurate and full information
- Remit the necessary deposit as detailed in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is only upon our receipt of payment and issuance of a written confirmation. We reserve full discretion to decline service to anyone.
3.3 Availability
All charter reservations are contingent upon the availability of vessels and favorable weather circumstances. We strive to fulfill your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All price quotes are in € and include relevant taxes unless indicated differently. Prices are subject to amendments without any prior announcement.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost required at the time of booking
- Remaining Balance: Due 48 hours before the charter departs
- Incidental charges (if applicable): Payable at the completion of the charter
4.3 Payment Methods
We accept mainstream credit cards, bank transfers, and authenticated cheques. Payment processing is managed through secure and encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Complete refund minus processing fees
- 24-72 hours before departure: 50% of the payment refunded
- Less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
If weather conditions are considered unsafe by our captain, we will propose to:
- Reschedule the charter without extra charges to a subsequent available date
- Issue a full refund if rescheduling proves unfeasible
5.3 Mechanical Issues
If there are mechanical failures with the vessel you are assigned, we will attempt to offer an appropriate alternative. Should no replacement be available, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all instructions from the crew
- Utilize safety gear as necessitated
- Disclose any health conditions that may affect their safety
- Stay within allocated spaces on the vessel
6.2 Prohibited Items
Items that are not allowed on board include:
- Glass containers
- Illegal substances
- Firearms or any weapons
- Large quantities of beverages beyond moderate consumption
- Pets (with exceptions if pre-approved)
6.3 Conduct
Passengers are expected to behave respectfully. A charter may be terminated ahead of time without a refund in the case of conduct that endangers safety or interferes with other guests' experiences.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount you paid for the charter. We will not be held responsible for:
- Injuries incurred due to passenger recklessness
- Thefts or damages to personal belongings
- Indirect, consequential, or punitive damages
- Delays caused by elemental conditions or situations beyond our purview
7.2 Insurance Coverage
We maintain all-encompassing marine insurance that protects our vessels and operations. It is the responsibility of passengers to secure their travel and personal insurance.
7.3 Assumption of Risk
By partaking in our charter services, you acknowledge the inherent perils of marine activities and take ownership of your safety and security.
8. Modifications and Itinerary Changes
We hold the right to alter itineraries, paths, or schedules due to weather changes, safety reasons, or other operational necessities. We will endeavor to provide equivalent alternative options.
9. Force Majeure
We disclaim responsibility for any hold-ups, annulments, or modifications spurred by issues not within our control, which incorporate but are not limited to:
- Severe weather events
- Natural catastrophes
- Governmental mandates
- Harbor shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your private data is managed following our Privacy Policy. Your use of our services signifies your agreement to our data collection and usage as outlined in our Privacy Policy.
11. Intellectual Property
The entirety of our website's content, such as text, visuals, logos, and images, is secured by copyright and trademark regulations. Reproduction, distribution, or the creation of derivative content is not allowed without our explicit consent.
12. Governing Law
These Terms comply with the legislation in Spain. Any arising disputes shall be adjudicated in the courts of Barcelona, Spain.
13. Changes to Terms
